Terms and conditions

These terms apply when you use the GMM Digital Art website, ask for a quote, order a website from us or buy a ready-made website template. Please read them before ordering. The Romanian version prevails in case of differences.

1. Who we are

The website and services belong to GMM Digital Art SRL, tax ID 51961527, Trade Register no. J2025042034006, Romania. We work remotely. You can reach us at gmmdigitalart@gmail.com and at +40 756 607 456 (phone and WhatsApp).

2. What we offer

• Custom websites: landing pages, business websites, online shops and their monthly care;
• Ready-made website templates: digital products (editor, guide and licence) that you customise yourself, with or without our help with publishing.

3. Custom websites

• Quote. Prices on the website are indicative (“from”). The final price, scope and delivery time are those in the written quote we send you and that you accept by email or contract.
• Payment. By bank transfer, against invoice: 50% upfront and 50% on delivery, unless the quote says otherwise.
• What you provide. Texts, logo, photos and business information. You must have the right to use them. If materials are late, the delivery date moves accordingly.
• Changes. The number of included revision rounds is set in the quote. Extra changes or new features are agreed separately.
• Domain and hosting. We recommend registering them in your name so they stay yours. Their cost, if any, is paid separately to the providers.
• Delivery. The website is delivered when it is published or when we send you the final files. After full payment, the website and the content created for you belong to you.
• Monthly care. Optional, paid monthly, and you can stop it anytime by email before the next month.
• Portfolio. We may show the website in our portfolio with a link to it. If you prefer we don’t, just tell us.

4. Ready-made website templates

• Price is the one shown on the Ready-made templates page, in euro, for the chosen option. Payment is by bank transfer with the payment reference shown at checkout. The invoice is issued in RON at the National Bank of Romania rate on the invoice date, unless stated otherwise.
• Delivery. Once the payment shows in our account, we email the package to the address you left in the form, usually the same working day and within 2 working days at most.
• The “+ publishing” option includes our help publishing the site in your Cloudflare account and connecting your domain. The domain cost is not included.
• The “do it for me” option is ordered through the contact form and follows section 3.
• Licence. You get a non-exclusive, perpetual licence to use the template for one website of one business. You may not resell, distribute or publish the template or the editor as such. Demo photos are from Unsplash under the Unsplash licence; fonts have open licences.
• If it doesn’t work. If the package does not work as described and we cannot fix the problem, we refund you.

5. Right of withdrawal

If you are a consumer, you generally have 14 days to withdraw from a distance contract without giving a reason (Romanian Government Emergency Ordinance 34/2014).

• Templates: they are digital content not supplied on a tangible medium. At checkout you expressly agree to immediate delivery and acknowledge that you thereby lose the right of withdrawal (art. 16 letter m).
• Custom websites: if you ask us to start before the 14 days end and then withdraw, you pay for the work done until then. Once the service has been fully performed with your consent, you can no longer withdraw (art. 16 letter a).

To withdraw, email us at gmmdigitalart@gmail.com. We refund what is owed within 14 days to the account you paid from. The right of withdrawal does not apply to businesses.

6. Liability

We work carefully, but we are not liable for outages or problems caused by providers we do not control (hosting, domain, email, Web3Forms, WhatsApp), nor for content you add to the website. Our total liability for an order is limited to the amount paid for that order, except where the law does not allow such a limit.

7. Personal data

We use your data only for quotes, orders and invoicing, as explained in the Privacy policy.

8. Complaints and disputes

If something isn’t right, email us at gmmdigitalart@gmail.com and we will reply within 5 working days. We try to settle any issue amicably. Otherwise, consumers can contact the Romanian consumer authority (ANPC) or use alternative dispute resolution (SAL). Disputes are settled by the competent courts in Romania under Romanian law.

9. Changes

We may update these terms. For an order, the version in force on the day you placed it applies.
